Terms and conditions
of purchasing
Please refer below to the terms and conditions regarding the purchase of Academy Of Intuition Pty Ltd (hereinafter "AOI") events (the "Courses") Business or personal ("Programs") or products (the "Product(s)"). If you have any queries relating to the specific terms and conditions for any course, program or product, please contact us or phone 1800 727 580.
Engagement:
1. Thank you for accepting our offer to provide you with courses, programs and/or products. By placing an Order/booking, you acknowledge that you have read our Terms and Conditions and agree that the placement of the Order/booking together with these Terms and Conditions form a contract between you and us.
Cancellation:
2. a) If you wish to cancel a Course or Program you can do so within 72hours of the Course or Program commencing. However, you will be charged 50% of your full tuition. If the cancellation is made within 72hours of the Course/Program commencing there is no refund.
A Course or Program payment must be paid in full within 72 hours of Course or Program commencement. After this period there are no refunds available. If you pay your Course fee several weeks or months prior to commencement of your course, you will be eligible for a 50% refund up until the 72nd hour no refund policy. If you pull out of a course and have paid in full before your 72hours no refund policy, we will only refund you 50% of your course fee.
Prior to booking in and paying for a course there will be an interview process whether by phone or face to face to support your decision of either entering into a course or choosing not to enter into a course.
Time, Place and Delivery of Seminar Services:
3. Your payment of the Investment to us entitles you the right to a seat at the Location during the Course Hours as agreed on the Event Details; and to receive a copy of the materials for Course Services. The above also applies to a Consultation when booked in.
4. When delivering Course Services, we may change the Course Days, Hours and / or the Location for any reason by notifying you in writing of the change and detailing substitute Course Days, Hours and/or Location and we shall have no liability to you; and you shall make no claim against us (including for a refund), in respect of the same.
Investment and Payment:
5. You must pay to us in consideration of the Course Services or the Programs:
(a) When a booking for a Course or Program is made 72 hours prior to commencement 50% of full tuition is to be paid. If booking for Course or Program is made within the 72hours of Course or Program commencement tuition is to be paid in full.
(b) if we have agreed that you may pay by Instalment, you must pay each Instalment to us in full and without set off or deduction of the Instalment Sum on the Instalment Payment Dates.
(c) All international payments are in Australian Dollars and are based on the current conversion rate at the time of booking/payment.
6. Payments made under this agreement must be made by the means specified in the Order.
7. If you should not pay to us an Instalment Sum by the Instalment Payment Date for that Sum then ALL monies owing by you to us shall become due and owing and must be immediately paid to us without set off or deduction or counterclaim and without need for further demand.
8. Should you continue to default on this payment, Academy Of Intuition will, at its discretion, refer your details to a debt collection agency to recover the outstanding balance. Until the debt is paid in full, your account will remain on hold and no further orders will be taken.
9. If Payments are not made by the due dates, place within the Course or Program will be cancelled and no refund or credit will be given.
Refunds:
10. We may cancel the Course or Program delivery for any reason by written notice or a phone call to you. We will then refund you the Investment you have actually paid to us within 14 days of giving you notice of cancellation. We shall have no further liability to you in respect of the cancellation.
11. You acknowledge that you shall not be entitled, and shall not claim a refund other than by strict compliance with Clause 2 or Clause 10. You further acknowledge that this is an essential term of this agreement on which we rely.
Transferring The Course or Program Services:
13. In the event that you are unable to attend the Course or Program you have booked and paid for, you may transfer your enrolment to the same Course or Program on a future date. You must let us know in writing or by phone within 3 days of choosing to not attend and changing to a future date of course or Program. You may not transfer your Course or Program to another person or different Course or Program other than the one you have booked in and paid for.
14. You must attend the new Course or Program within twelve months of the initial transfer notification date.
Non Attendance
15. If you do not attend the Course or Program you have booked and paid for, without notifying us in writing prior to the Course or Program commencing, your spot will be deemed to be abandoned by you and you will not be entitled to any Course or Program, any associated materials, bonuses or gifts, nor any refund of money paid or other claim to any further compensation.
Intellectual Property:
16. We have all right, title and interest in all intellectual property used by us for the Courses, Programs and Products.
17. In performing the Courses, Programs and Products for you, we do not transfer title to you in any intellectual property and title to all such intellectual property remains with us.
Disclosures:
19. You acknowledge that neither we, any of our representatives or any person we engage to perform the Courses and Programs or contents of any Product material ('Relevant Persons') is an investment advisor or licensed by ASIC or any other governmental authority to provide investment advice; that the Relevant Persons do not purport to provide investment advice or operate an investment advice business (as defined in the Australian Securities and Investments Commission Act 2001 or Corporations Act 2001); and we may pay commissions to third parties arising from your entering into this agreement.
Other Documents:
20. Subject to your rights under the Privacy Act 1988, you may be required to complete and deliver to us other documentation, including questionnaires.
Limitation of Liability:
21. You agree to limit any claim on Academy Of Intuition to the cost of re-supply of equivalent products or services. The Trade Practices Act and similar State and Commonwealth Legislation in Australia may confer rights and remedies on you in relation to the supply of the Products or Course and Programs Services which cannot be excluded, restricted or modified. Academy Of Intuition does not exclude such non-excludable rights but does exclude all other conditions and warranties implied by custom, law or statute.
We:
(a) exclude all terms, conditions and warranties implied by custom, the general law or statute or which cause any part of this agreement to be void (Excludable condition');
(b) limit our liability to you for breach of any Excludable Condition to the total amount actually paid by you under this agreement;
(c) limit our liability to you for any claim (whether arising in contract, tort or statute) for loss or damage suffered by you in relation to the performance of the Course, Products or Programs Services to the total amount actually paid by you under this agreement; and
(d) excludes all liability for contingent consequential direct indirect special or punitive damage (including but not limited to, lost revenue or lost profit) suffered by you in any way relating to the Course, Products or Programs Services or your exercise of rights under this agreement.
